General terms and conditions of business

SERENGETI-PARK HODENHAGEN GMBH (AS OF DECEMBER 2016)

Section 1 Scope of Application
The following General Terms and Conditions (hereinafter also referred to as "GTC") apply to the use of the online shop/online ticketing system of Serengeti-Park Hodenhagen GmbH (hereinafter referred to as Serengeti-Park) for the purchase of goods, admission tickets, or vouchers for admission tickets, and for all resulting contractual relationships between Serengeti-Park and its customers. Information regarding data protection is subject to separate regulations. Serengeti-Park does not recognize any terms and conditions of the customer that deviate from these GTC.

Section 2 Conclusion of Contract

(1) The presentation of goods, admission tickets, or vouchers for admission tickets in the online shop does not constitute a binding offer to conclude a purchase agreement. Rather, it is a non-binding invitation to order goods in the online shop.

(2) By clicking the "Submit Order" button, you are submitting a binding offer to purchase (§ 145 German Civil Code). Prior to this, the customer must correctly enter their personal data and all necessary information for payment processing (currently available at www.serengeti-park.de), as well as accept the Terms and Conditions.

(3) After receiving your offer to purchase, you will receive an automatically generated email confirming that we have received your order (order confirmation). This order confirmation does not yet constitute acceptance of your offer to purchase. A contract is not yet formed by the order confirmation.

(4) A purchase contract for the goods is only concluded when we expressly declare acceptance of the offer to purchase or when we ship the goods to you – without prior express declaration of acceptance.

(5) Ordering via the online shop thus comprises a total of four steps. In the first step, the customer selects the desired goods or tickets. In the second step, the customer enters their customer data, including billing address. In the third step, the customer enters the data required for the payment process. In the final step, the customer has the opportunity to review all information and correct it if necessary before submitting their order to Serengeti Park by clicking "Submit Order."

(6) The order text is stored by Serengeti Park. The customer can print it before submitting their order to Serengeti Park by clicking "Print" in the final step of the order process. Serengeti Park will send the customer an order confirmation and an order acknowledgement with all order details and the General Terms and Conditions to the email address provided by the customer.

Section 3 Prices

(1) Unless expressly stated otherwise, all prices quoted include the applicable statutory value-added tax (VAT) and exclude any shipping or packaging costs.

(2) Shipping and packaging costs, if applicable, will be shown separately.

(3) Prices are subject to change without notice. Errors and omissions excepted.

Section 4 Payment and Payment Processing
(1) Unless otherwise specified, payment can be made by credit card, PayPal, or online bank transfer. Serengeti Park reserves the right to restrict payment to specific credit card providers.

(2) The total price of the order, including all fees and charges, is due immediately upon conclusion of the contract.

(3) The goods and tickets remain the property of Serengeti Park until full payment has been received.

(4) Serengeti Park is entitled to use the services of third parties, such as external service providers, for payment processing and/or receipt of payment. Therefore, a different payee than Serengeti Park may be listed on the invoice or in the corresponding account details.

(5) Should a payment be reversed, Serengeti Park is entitled to the immediate return of the ordered goods and tickets or is entitled, but not obligated, to withdraw from the contract and invalidate the tickets or the barcode sent. The customer shall compensate Serengeti-Park for any damages resulting from a chargeback. In the event of a chargeback, the customer shall reimburse Serengeti-Park for the incurred bank fees as well as a processing fee of EUR 5.00 per chargeback. In the event of contract cancellation by Serengeti-Park, Serengeti-Park reserves the right to also charge the customer a processing fee of EUR 5.00.

Section 5 Offsetting/Right of Retention

(1) The customer is only entitled to offset payments if their counterclaim has been legally established, is undisputed by us, or is acknowledged by us, or if it is in a close reciprocal relationship with our claim.

(2) The customer may only exercise a right of retention to the extent that their counterclaim is based on the same legal basis.

The contractual relationship is based on this.

Section 6 Delivery of Digital Goods (Admission Tickets)

(1) Admission tickets are delivered by email as a PDF attachment in the form of a "self-print ticket" (with a barcode). The customer must enter their correct email address online for this purpose.

(2) The printed ticket (PDF file) sent electronically to the email address provided by the customer serves as the admission ticket. No further tickets will be sent by post.

(3) Delivery is subject to availability. Compensation for delayed delivery is excluded.

(4) If the customer does not receive the confirmation email with the printable ticket within 24 hours of booking, they are obligated to inform Serengeti-Park immediately. The same applies to problems printing the admission tickets. Failure to do so will preclude any claims for lost admission tickets.

Section 7 Delivery of Other Goods

(1) The characteristics of the ordered goods are as described in the product description in the online shop. Weight, dimensions, and other technical data are specified as precisely as possible but may be subject to standard variations. In particular, color variations are possible for technical reasons. The characteristics described here do not constitute defects in the products delivered by Serengeti-Park.

(2) If no units of the product selected by the customer are available at the time of ordering, Serengeti-Park will inform the customer immediately. If the product is permanently unavailable or cannot be delivered, Serengeti-Park reserves the right to withdraw from the contract and will promptly refund any payments already made by the customer for the product in question.

(3) Delivery is subject to the stated shipping costs.

(4) Goods are generally shipped within 3-5 business days after receipt of payment.


Section 8 Handling and Validity of Tickets (Admission Tickets)
(1) The customer may only make one printed copy of the admission tickets or vouchers ordered for their intended use. A self-printed ticket entitles the customer to one admission only.

(2) The customer is not authorized to reproduce, duplicate, and/or alter the ticket.

(3) An admission ticket that has been duplicated and/or resold without authorization does not entitle the holder to visit Serengeti Park.

(4) The unique barcode on the admission ticket will be electronically validated at the venue using a barcode scanner. Multiple uses by duplicating the barcode are prohibited.

(5) Serengeti Park reserves the right to refuse entry to anyone possessing barcode copies or unauthorized duplicated admission tickets. Furthermore, Serengeti Park reserves the right to claim damages and file criminal charges against customers misusing self-printed tickets. Serengeti Park is not responsible for any inconvenience and/or damage caused by unauthorized duplication or misuse of tickets.

(6) The customer is obligated to keep the ticket or self-printed ticket in a safe place and protect it against misuse, just like cash or traditional tickets. Serengeti Park assumes no responsibility for lost or misused tickets and will not provide a replacement.

(7) Resale to third parties is expressly prohibited.

(8) Proof of eligibility for discounts, along with personal identification, must be presented at the entrance without being requested. If the corresponding proof of eligibility is not presented, the customer must pay the difference to the regular price at the ticket office to be eligible for admission.

(9) Tickets purchased with a validity stamp are valid for the date, time, and period specified at the time of purchase.

(10) Admission is subject to the opening hours of Serengeti Park or the dates indicated on the tickets. The opening hours are determined by Serengeti Park.

(11) Serengeti Park reserves the right to refuse admission in cases of overcrowding and/or for other safety reasons and/or to terminate visits prematurely.

Section 9 Right of Withdrawal and Return, Cancellation Policy

There is no right of withdrawal for day-specific or season-specific tickets – these tickets are non-refundable!

(1) With regard to the sale of tickets with a fixed validity date (day- or season-specific tickets!), the customer has no right of withdrawal or return, since, according to Section 312g Paragraph 3 No. 9 of the German Civil Code (BGB), the regulations on distance selling do not apply to contracts for the provision of services in the field of scheduled leisure events. The order becomes binding immediately upon confirmation by Serengeti-Park and obligates you to accept and pay for the order.

(2) Cancellation Policy: The following applies to other goods, as well as tickets and vouchers without a specified expiry date:
If you are a consumer within the meaning of Section 13 of the German Civil Code (BGB), i.e., you are making the purchase for purposes that are predominantly neither related to your commercial nor your independent professional activity, you have a right of cancellation in accordance with the following provisions.

Right of Cancellation
You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

You must inform us of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post, fax or email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
