LEGAL NOTICE

Park and Visitor Regulations of Serengeti-Park Hodenhagen GmbH

Date: November 2020

A warm welcome to Serengeti-Park

We are delighted to welcome you and aim to ensure that both you and the other visitors to our park have a wonderful experience. We therefore ask that you continue to show the usual consideration and caution. Above all, this means taking responsibility for yourself and others and observing the basic rules of courtesy. Safety is our top priority at Serengeti-Park, and you can support us in our efforts. Please observe the following rules of our Park and Business Regulations carefully, as they form the basis for your visit to Serengeti-Park.

1. Parking

The rules and signage of the Road Traffic Regulations (StVO) apply in our parking areas. Visitors to Serengeti-Park must park their vehicles in the designated visitor parking areas. The parking area for the Safari Lodges is reserved exclusively for overnight guests. The staff parking area may be used only by employees of Serengeti-Park. To ensure the smooth flow of traffic, instructions given by our parking attendants must be strictly observed. Please park your vehicle only within the designated parking spaces. If you park your vehicle outside these areas and thereby obstruct traffic, we reserve the right to have the vehicle towed at your own risk and expense. When leaving your vehicle, please ensure that the doors, trunk, windows, and sunroof are closed and that no items are left inside the car. We also ask that you do not leave any animals unattended inside your vehicle. Serengeti-Park Hodenhagen GmbH assumes no liability for theft of or damage to your vehicle caused by third parties. This exclusion of liability also applies in cases where damage is caused by storms, fire, hail, explosions, or other extraordinary events. This exclusion of liability does not apply, however, if the damage was caused by gross negligence or willful misconduct on the part of Serengeti-Park GmbH staff members. Compensation for damages can be provided only if you report the damage to our administrative staff before leaving Serengeti-Park, provided that such reporting is reasonable under the circumstances.

2. Admission

The grounds of Serengeti-Park may be entered only with valid admission tickets and exclusively via the designated visitor entrances. Access to Serengeti-Park via the Lodge complex is available solely to overnight guests. Admission tickets must be retained throughout the visit and presented upon request. Tickets purchased at the park's ticket office are valid only on the day of purchase. Tickets purchased online are valid for the duration of the current season (promotional tickets are exempt and are marked accordingly if they have a limited validity period). The right of admission expires upon leaving the park grounds. An admission ticket entitles the holder to utilize all services offered at the time of the visit for which no separate fee is charged. Services requiring a separate fee are clearly marked as such.

Persons under the influence of alcohol or drugs may be refused entry to the park or may be expelled from the park grounds.

Children under the age of 12, as well as persons who lack the necessary maturity to observe the park rules—or who require constant supervision due to their mental or physical condition—may move about the Serengeti-Park grounds only if accompanied by an adult (18 years or older) who is responsible for their supervision.

3. General Safety Regulations

Dogs are welcome guests but must be kept on a leash at all times. Dogs are not permitted at show performances, on the Serengeti Bus (double-decker), or in the Jungle Safari, Quad Safari, Aqua Safari, Splash Safari, Black Mamba, Safari Specials, amusement rides, or specifically designated areas of the park. Other pets may not be brought into the park.
Fire safety regulations within the park grounds must be strictly observed. Smoking is prohibited while using any of the attractions. This also applies to queuing areas, restaurants, as well as during shows, performances, and/or in areas with large crowds.
We take the "Youth Protection Act" very seriously. Anyone failing to comply with this regulation will be expelled from the park without entitlement to a refund of the admission fee. Visitors must not leave the designated paths or marked roads. Safety barriers, fences, gates, enclosures, and walls must under no circumstances be climbed over. Walking on the lawns is prohibited. Throughout the entire Serengeti Safari area, visitors enter at their own risk; this applies to both persons and personal property. Driving through the Serengeti Safari is permitted only in a private vehicle or on the Serengeti Bus. In the designated enclosures within the Serengeti Safari, exiting your private vehicle or the Serengeti Bus is strictly prohibited. Exiting your private vehicle is permitted only in the "Ivory Valley" area. The following rules apply in this area:

Children must be accompanied by and remain under the supervision of adults.

Your vehicle must remain under supervision at all times.

Dogs should remain inside the vehicle.

Animals must not be fed with food brought from outside the park.

Respect the animals.

Be considerate of the animals, paying particular attention to young animals and animals lying down—therefore, drive only on the designated roads and paths. Serengeti-Park Hodenhagen GmbH assumes no liability for accidents occurring outside of marked public pathways, or on specifically designated operational and staff routes, on the grounds of a breach of its duty of care. The possession and carrying of weapons or dangerous objects (pistols, knives, chains, brass knuckles, etc.), as well as fireworks, bottles, cans, and intoxicants, are strictly prohibited both within and immediately outside the Serengeti-Park premises. For the sake of your own safety and to ensure the orderly operation of the park, you must comply with all instructions issued by park staff.

Willful loud behavior and the loud operation of portable music devices are prohibited. The wearing of outerwear and shoes is mandatory. For safety reasons, guests are not permitted to bring bicycles, balance bikes, tricycles, scooters, skateboards, roller skates, sleds, or similar items onto the premises.
Due to adverse weather conditions (rain, freezing rain, snowfall, etc.) or splashing water from water-based attractions, slippery surfaces may occur throughout the park. Guests are therefore advised to exercise due caution and care throughout the entire park area; to wear closed-toe footwear with good traction; to refrain from walking or running at high speeds; and to utilize available handrails. Swimming or entering the water in any form is strictly prohibited in all water areas.

Cannabis Consumption: For reasons of safety (particularly in the vicinity of vehicles and rides), child and youth protection, and animal welfare, the consumption of cannabis in any form is strictly prohibited throughout the entire park premises. Please adhere to this regulation at all times; in the event of a violation, we will exercise our right of domicile and immediately remove you from the premises.

4. Use of Facilities and Attractions in the Amusement Park

The facilities within the amusement park are available for your use subject to their respective rules of use. Please strictly observe the instructions provided by the operating staff at all times. Should you willfully disregard the usage guidelines, operating instructions, or staff directives, the operating staff reserves the right to prohibit you from using the attraction; such exclusion shall not give rise to any claim for compensation on your part. This also applies if you attempt to "cut in line" in a queue.

You are liable for any damages resulting from a failure to observe the operating instructions or from willful damage. In the event of a power outage caused by thunderstorms, storms, or other occurrences—and the resulting temporary shutdown of facilities or attractions—no refund (whether full or partial) of the admission fee paid may be claimed. In cases of strong winds, reduced visibility, thunderstorms, or other adverse weather conditions, we reserve the right to suspend the operation of specific facilities or attractions in order to ensure the safety of our visitors. Under such circumstances, no claim for a refund of the admission fee—whether full or partial—shall exist.

5. Use of Playgrounds

The use of playground equipment, play areas, and similar facilities is at one's own risk. The use of playground equipment by adults is prohibited.

6. Supervisory Duty

We remind all parents and group chaperones to diligently fulfill their duty of supervision, as we cannot absolve them of this responsibility. In this context, supervisors and parents bear responsibility for any damages caused by those under their supervision.

7. Limitations of Liability

Entry into and presence within the Serengeti-Park—as well as at the individual attractions of the Adventure Safari, Serengeti Safari, and Jungle Safari, and other facilities—is at your own risk. We shall be liable for any damages caused by a culpable breach of a material contractual obligation, or which are attributable to gross negligence or willful misconduct. In the event of a breach of a material contractual obligation without the presence of gross negligence or willful misconduct, we shall not be liable for unforeseeable or atypical damages. Our liability for injury to life, body, or health, as well as liability under the Product Liability Act, for defects fraudulently concealed, or for the assumption of a guarantee regarding the quality of an item, remains unaffected.
Serengeti-Park GmbH assumes no liability for items handed over to park staff or left unattended on the park premises. No liability is assumed for any items—including, but not limited to, mobile phones, cameras, jewelry, shoes, etc.—that are damaged, destroyed, or lost while using an attraction. The provision of first aid services by the park’s own staff does not constitute a substitute for any medical treatment that may be required.

8. Reporting of Damages

All facilities within the park are carefully maintained and monitored. Should you nevertheless sustain injury or damage through no fault of your own, you must report the incident to the Reception/Administration office before leaving the park premises. You must also report an incident if there are grounds to believe that it could potentially result in damage or injury at a later time. Any claim for compensation shall be deemed invalid if a report—which was both possible and reasonable to make at the time—is submitted only after leaving the park.

9. Advertising and Offering of Goods and Services

Advertising on the park grounds or in the parking areas, as well as the offering of goods or services, is permitted only with the prior written consent of the park management. This also applies to the conducting of opinion polls and surveys. Advertising and public announcements on behalf of organizations, associations, special interest groups, or personal causes—using any means whatsoever—are prohibited within the park grounds and inside all buildings, rides, etc. Violations will be penalized in each individual case by immediate expulsion from the park, civil action, and criminal charges for trespassing.

10. Filming and Photography for Promotional Purposes

Filming and photography are conducted within Serengeti-Park. The specific areas and attractions involved are marked whenever possible. Please avoid these areas if you do not wish for any footage or photographs featuring you to be subsequently used for public purposes; alternatively, please inform the photographer or film crew of your preference. Failure to do so will be interpreted as consent for such usage without remuneration.

Photography and filming on the publicly accessible grounds of Serengeti-Park Hodenhagen GmbH are permitted solely for private purposes, provided that other guests or the animals are not disturbed or adversely affected in the process. Photographers and videographers are personally responsible for ensuring the protection of any personal rights and for complying with data protection regulations at all times. Filming and photography while using an attraction are permitted only with prior written authorization. Staff instructions must be followed at all times.

Photography and filming for strictly editorial purposes are permitted but require a prior written request.
Conversely, photography and filming intended for commercial use—specifically including publication on social media platforms such as Facebook, YouTube, Instagram, TikTok, Pinterest, SnapChat, Twitch, Flickr, Vero, Vimeo, etc.—are permitted only with prior written authorization. To obtain such authorization, please contact the Serengeti-Park Press Office in advance via info@serengeti-park.de.

In the event of a violation of these filming and photography regulations, we reserve the right to exercise our domiciliary rights; consequently, the offending individual will be immediately expelled from the park grounds and issued a comprehensive, permanent ban prohibiting their future entry into or presence on the entire premises of Serengeti-Park.

11. Additional Conditions During the Coronavirus Pandemic

Access to Serengeti Park is permitted only to persons without any suspicious symptoms of COVID-19 (e.g., fever, cough, shortness of breath).

The contact restrictions issued by the State of Lower Saxony also apply on the grounds of Serengeti Park. A minimum distance of 1.5 meters must be maintained from other persons who do not belong to the same household. The distance markers and posted hygiene guidelines must be followed. In order to comply with the applicable hygiene regulations of the Lower Saxony ordinance, there may be restrictions on the range of activities offered and the closure of certain areas of Serengeti Park.

12. Right of Admission

The theme park reserves the right to remove persons who violate the park rules or who are found on the park grounds without a valid ticket. Anyone who disturbs other visitors, uses the facilities contrary to the existing usage instructions and restrictions, fails to comply with the instructions of staff, these park regulations, or mandatory signs, or otherwise causes a disturbance, may be removed from the park premises without any entitlement to a refund of the admission fee.

13. Place of Performance, Jurisdiction

The exclusive place of jurisdiction for all disputes arising from or in connection with this contractual relationship, as well as the place of performance for payment, delivery, and services, is the registered office of Serengeti-Park Hodenhagen GmbH, Walsrode Local Court.

14. Applicable Law, Supplementary Agreements, Contact

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). No oral supplementary agreements exist. Should individual provisions of these park regulations be or become wholly or partially invalid, unenforceable, or ineffective, the validity of the contract and the remaining provisions shall not be affected.

We wish you a wonderful day and much enjoyment.
